PART A — General Provisions
1. Provider and Scope
1.1 These General Terms and Conditions apply to all contracts concerning the use of the online platform ‘Mediations Akademie online’, accessible at www.mediations-akademie.online (hereinafter referred to as the ‘Platform’), between Michael Lardy, Moosstrasse 84a, 5020 Salzburg, Austria, email:mail@mediations-akademie.online , (hereinafter referred to as the “Provider”, “we” or “us”) and the respective user (hereinafter referred to as “you” or “User”).
1.2 Any deviating, conflicting or supplementary terms and conditions of the user shall only form part of the contract if we expressly agree to their validity. Mandatory statutory rights of consumers remain unaffected.
1.3 As a general rule, the version of these General Terms and Conditions in force at the time the contract is concluded shall apply. The General Terms and Conditions can be accessed and saved at https://mediations-akademie.online/training/agb/. The contract confirmation shall be sent on a durable medium, in particular by email.
2. Consumers or Business Users — Classification
2.1 A consumer is anyone who does not enter into the contract for the purpose of operating a business (Section 1(1)(2) of the Consumer Protection Act (KSchG)). A trader is anyone for whom the transaction forms part of the operation of their business (Section 1(1)(1) and (2) of the Consumer Protection Act (KSchG)).
2.2 Transactions entered into by a natural person prior to commencing the operation of their business, for the purpose of creating the necessary conditions for doing so, may be treated as consumer transactions under Section 1(3) of the Consumer Protection Act (KSchG). Mandatory consumer rights cannot be excluded by a self-classification to the contrary.
2.3 During registration, we will ask whether you are acting as a consumer or a trader. Where necessary for billing, invoicing or tax purposes, traders may be required to provide additional details such as the full company name, business address, job title, legal form and VAT number. You are obliged to ensure that this information is accurate and up to date.
2.4 We are entitled to verify your status as a business and any tax-relevant details to a reasonable extent.
3. Subject matter of the contract and description of services
3.1 Mediations Akademie online is a web-based, multilingual training platform in German, English and French for interactive communication and mediation training.
3.2 In the structured exercises, an AI system generates a realistic conversation scenario or a statement from a fictional party to a conflict. You formulate a response in writing or, optionally, via voice input. An AI system assesses the response against specialist criteria, awards a score and generates written feedback.
3.3 The current training programme includes, in particular, the following areas and exercises:
Fundamentals of communication: active listening, reframing, paraphrasing, the 4-ears communication square
Effective questioning techniques: circular questions, hypothetical questions, scaling questions, reframing questions
Handling difficult situations: aggrieved parties, personal attacks, silence, power imbalances, uncooperative clients
3.4 In addition, a free AI chat for questions relating to communication and mediation, as well as a separate chat page featuring AI models authorised by us, may be offered. These functions use the same user account and credit balance.
3.5 The platform is designed for use with current web browsers and is compatible with desktop computers, smartphones and tablets; where supported by the respective device, it can be installed as a web app on the home screen. A microphone is also required for voice input.
3.6 The platform is intended solely for training and practice purposes. It does not provide any medical, psychotherapeutic, psychological, mediation or legal advisory services. AI-generated content is no substitute for professional advice.
3.7 The platform is not an examination, qualification or certification system. Scores and AI assessments are personal training guidelines and do not constitute objective evidence of professional qualification. We do not determine whether a user has passed or failed, nor do we forward training results to employers, training institutions, professional bodies or any other third parties.
3.8 We are obliged to provide the platform in its current form. Individual exercises, functions or AI models may be further developed, amended or replaced in accordance with clause 14.
4. Registration and user account
4.1 Registration and use of the platform are permitted exclusively to persons who have reached the age of 18.
4.2 A user account is required to use paid features. Registration is carried out using a valid email address and a password. The account is only activated once the confirmation link sent to you has been clicked.
4.3 You are obliged to ensure that the details provided during registration are accurate and up to date, and to protect your login details from access by third parties. The user account is personal and, in principle, non-transferable.
4.4 If you suspect unauthorised use, please notify us at mail@mediations-akademie.online and change your password immediately.
4.5 In your personal settings – where available – you can control, in particular, the language, AI model, result storage and other optional functions.
5. Conclusion of the contract and top-up of credit
5.1 Upon confirmation of your registration, a free-of-charge contract of use is concluded for an indefinite period. This does not give rise to any payment obligation on your part. Only the data necessary for the provision of the user account will be processed.
5.2 Each top-up of credit for a fee constitutes a separate, paid contract (top-up contract) based on the user contract set out in 5.1. For consumers, the statutory right of withdrawal applies to the individual top-up contract in each case, not to the registration.
5.3 You select one of the credit top-up packages on offer, check your details and place a binding order by clicking the ‘Place order with payment’ button. The contract for the relevant credit top-up comes into effect upon our confirmation of payment for that top-up; the date of this payment confirmation is decisive. The payment confirmation will be sent to you by email, and the credit will be credited to your user account at the same time. This date also determines the start of the withdrawal period as set out in clause 17.
5.4 Consumers may, for each top-up, expressly request that the credit purchased be made available for use before the expiry of the statutory withdrawal period. This request is obtained separately for each top-up. Clause 17 applies to the consequences of a withdrawal.
5.5 Input errors can be corrected using the technical functions provided before the order is submitted. The contract language is German, English or French, depending on the language version selected at the time the contract is concluded at . The text of the contract is stored to an appropriate extent and confirmed on a durable medium.
6. Usage credit, usage charges and billing
6.1 There is no subscription, no recurring basic fees, no minimum term and no automatic contract renewal. Chargable usage is paid for from a credit balance purchased in advance.
6.2 The credit purchased for a fee is held as a credit balance on your user account. The use of chargeable AI functions is billed according to actual usage.
6.3 The final price of an individual exercise or AI query cannot be determined exactly before use begins. It depends in particular on the AI model used, the volume of text or tokens processed, the scope of the input, the output generated and other technical usage factors.
6.4 In addition to the costs of external AI services, the usage charges also take into account costs for the provision, operation, infrastructure and further development of the platform. The underlying usage rates may be adjusted for future usage. Any adjustment will not apply retrospectively to usage that has already taken place.
6.5 Upon completion of an exercise or AI usage, the actual costs incurred are displayed and deducted from the available credit balance. The current credit balance and the total usage costs incurred on the respective day can be viewed in the customer account.
6.6 Credit already purchased retains its nominal value. There is no entitlement to use a specific amount of credit to access a specific number of exercises, AI queries, tokens or other services on a permanent basis at unchanged usage rates.
6.7 Top-up credit purchased for a fee does not expire as long as the user account remains active. We do not charge any inactivity, administration or account management fees. Clause 15.4 applies to refunds upon termination of the user agreement.
6.8 We may grant free starter, trial or bonus credit. There is no legal entitlement to such credit. Such free credit is non-transferable and will not be paid out in cash.
7. Payment options and invoicing
7.1 The payment options currently available will be displayed to you before you complete a credit top-up. There is no entitlement to the continued availability of a specific payment method.
7.2 An electronic invoice is issued for every credit top-up made for a fee and made available for download as a PDF in your customer account, provided this is technically and legally feasible.
8. Use of artificial intelligence and the limitations of AI
8.1 You interact with AI systems on the platform. Tasks, assessments, scores, feedback texts, chat responses and, where applicable, voice outputs are generated automatically. A corresponding transparency notice is displayed in the training interface.
8.2 AI systems from various external providers may be used to deliver the AI functions. These providers may be based within or outside the European Economic Area. There is no entitlement to the continued provision of a specific provider or AI model. We may add, replace or remove providers and models, in particular for technical, qualitative, economic or legal reasons.
8.3 The providers currently in use, as well as the information relevant to data processing, are set out in the privacy policy.
8.4 The processing of inputs by external AI providers is governed by the technical and data protection frameworks applicable to the respective service. The use of inputs by individual providers to improve or train their systems cannot be generally ruled out. For this reason, and due to the platform’s exclusive training purpose, the prohibition on the use of real personal data as set out in clause 11.1 applies.
8.5 AI systems operate on a probability-based basis. Outputs may be incomplete, factually incorrect, inappropriate or contradictory, and may contain fabricated content. Identical or similar inputs may result in different assessments or scores. Scores are indicative values for personal training and do not constitute an objective measure of professional competence.
8.6 For voice inputs, the AI assessment system receives only the transcribed text. It does not perceive intonation, pitch or other acoustic expressions and will not treat these characteristics as the basis for an assessment.
8.7 The conflicting parties, situations and statements presented are generated for training purposes and are intended to be fictional. Any resemblance to real persons or events may be coincidental.
8.8 You are solely responsible for deciding whether and how you use the training prompts in your private or professional practice. Obviously incorrect or technically faulty outputs can be reported at mail@mediations-akademie.online. A credit may be issued as a gesture of goodwill, without this constituting an acknowledgement of a defect.
9. Voice input and speech output
9.1 At the start of a usage session, the consents and notices required for optional functions are displayed collectively. Consent to voice input applies to the current session and does not need to be given again before each individual instance of voice input.
9.2 Voice input is optional. All exercises can also be completed using the keyboard.
9.3 A voice recording is processed exclusively for automated transcription. The AI assessment system receives only the text generated from it, not the audio file. The audio file is deleted on the server once transcription is complete and is not stored permanently.
9.4 There is no speaker recognition, creation of voice profiles, voice cloning or analysis of emotions, intonation or pitch.
9.5 AI-generated practice texts can optionally be read aloud using a synthetic, computer-generated voice. Where available, users can choose between different voices.
9.6 Automatic transcription may be inaccurate, particularly in the case of dialects, background noise or technical terms. Users should check the transcribed text before submitting an assessment.
10. Storage of results and progress
10.1 Exercise results, scores and progress data are only stored for the purpose of personal progress analysis if you explicitly enable result storage.
10.2 When saving is enabled, your history, average and best scores, as well as individual exercise sessions, can be viewed in your user account.
10.3 Saved exercise content and progress data can be deleted or reset using the functions provided. Where a partial deletion only removes the content of a single session, a score may be retained for statistical purposes, provided this is clearly indicated in the user interface.
10.4 Unless result storage is activated, the relevant exercise results will not be permanently stored for the purpose of personal progress evaluation. Technical log or billing data required by law remain unaffected by this.
11. Users’ obligations and prohibition on real case data
11.1 The platform is exclusively a training and practice tool. No personal data relating to real individuals and no content from real cases may be entered into exercises or AI chats that could be used to identify a person directly or indirectly. This applies in particular to names, contact details, specific identifying case descriptions and special categories of personal data within the meaning of Article 9 of the GDPR. Please use only fictional or effectively anonymised scenarios. Pseudonymised information is not considered anonymous if identification remains possible on the basis of further details or the context.
11.2 The following are also prohibited in particular:
content that is unlawful, offensive, infringes personal rights, glorifies violence or is otherwise manifestly unacceptable;
bots, scripts, crawlers or other automated processes designed for mass use or the systematic extraction of data from the platform;
circumventing security measures, usage restrictions or credit billing;
the disclosure of the user account or login details to third parties;
the use of the platform as a general AI service outside its intended training purpose or to circumvent the terms of use of external AI providers;
offering the platform under one’s own name or brand without the provider’s express consent.
11.3 In the event of serious or repeated breaches, we may temporarily suspend access following a prior warning and the setting of a reasonable deadline, or terminate the contract with immediate effect. A prior warning is not required if it would be unreasonable given the seriousness of the breach.
12. Rights to content
12.1 The platform, its structure, design, texts, task logic, assessment criteria and software are protected by copyright and related rights. For the duration of the user agreement, you are granted a simple, non-transferable right to use the platform personally in accordance with the terms of the agreement.
12.2 You retain the rights to your own user-generated content. You grant us the rights necessary for the technical provision of the service to process the user-generated content and to transmit it to the relevant AI providers, insofar as this is necessary for the provision of the selected function and is legally permissible.
12.3 You may use AI outputs generated specifically for you and the insights derived therefrom for your own private and professional purposes. We do not assert any exclusive rights against you in this regard, insofar as we are entitled to such rights at all.
12.4 You are not permitted to systematically extract, collect, reproduce or publish platform content for the purpose of creating competing services, databases, training systems or AI models, nor are you permitted to resell collected platform content.
13. Availability, Maintenance and Technical Faults
13.1 We endeavour to ensure a high level of platform availability, but do not guarantee any specific availability rate.
13.2 Temporary restrictions may arise, in particular, due to maintenance work, technical faults, outages of external services, security measures or events beyond our control. Where possible, we carry out scheduled maintenance work during off-peak hours.
13.3 If a paid exercise or AI enquiry cannot be completed properly due to a technical fault, the credit deducted for this will be refunded. Should the automatic refund not take place, you may contact mail@mediations-akademie.online.
13.4 In the event of use that is clearly automated, abusive or poses a threat to technical stability, appropriate technical usage restrictions may be put in place.
14. Changes to the Platform and these Terms and Conditions
14.1 We may amend the platform beyond necessary updates where there is a valid reason to do so, in particular due to changes in technical conditions, legal requirements, security risks or changes in the availability and performance of external AI services, and provided that the legal requirements for such an amendment are met.
14.2 In relation to consumers, changes to continuously provided digital services shall be made in accordance with mandatory statutory provisions, in particular the VGG. In the event of an impairment that is not merely minor, we shall provide timely notification on a durable medium and draw attention to existing statutory rights of termination.
14.3 A change, addition or removal of an AI provider or AI model does not in itself constitute a material impairment, provided that the central training purpose and the essential functions of the platform are maintained.
14.4 Amendments to these General Terms and Conditions shall generally be announced by email at least four weeks before they come into force. Consent by way of non-objection is only envisaged for objectively justified, non-material amendments, in particular those resulting from changes to the legal framework, editorial clarifications, changes to contact or company details, or similar adjustments that do not materially alter the contractual balance to the detriment of the user. The significance of silence and the option to object are expressly highlighted in the notification of changes.
14.5 Material changes to key contractual obligations or user rights to the user’s detriment, as well as retrospective changes to usage agreements already concluded, shall not be deemed agreed to solely by the user’s silence. Where required by law, we shall obtain express consent for this.
14.6 Changes to variable usage rates for future usage are governed by clause 6 and do not constitute a retrospective change to services already provided.
15. Contract Term, Termination and Account Closure
15.1 The user agreement is concluded for an indefinite period. There is no minimum term.
15.2 You may terminate the user agreement at any time without notice by using the designated account deletion function or by sending a notice to mail@mediations-akademie.online.
15.3 We may terminate the user agreement with one month’s notice to the end of the month. The right of both parties to terminate the agreement for cause remains unaffected.
15.4 Upon termination of the User Agreement, we shall, at your request, refund any credit balance purchased for a fee that remains at that time. This applies regardless of which party terminated the agreement. Where possible, the refund will be made via the payment method used for the relevant top-up; otherwise, it will be paid into an account specified by you. Credit that has already been used will not be refunded. If, at your own request, you choose a different payment method for the refund than the one used for the top-up, we may deduct the additional costs actually incurred as a result. We will inform you of the amount of these costs before the refund is made.
15.5 Start-up, trial and bonus credit provided free of charge will not be refunded and will not be paid out in cash.
15.6 Upon complete deletion of the user account, the exercise content, results, progress data and personal settings stored therein will be deleted, provided that this does not conflict with any statutory retention obligations. Invoice, booking and payment data will be retained for as long as required by law. Please download any necessary invoices before deleting your account.
PART B — Additional provisions for consumers
This section applies to consumers within the meaning of Section 1 of the Consumer Protection Act (KSchG) and in cases where mandatory consumer protection law applies.
16. Prices and VAT
16.1 Before completing a top-up, the total price payable for the selected top-up package will be displayed. No additional delivery or postage costs apply. You are responsible for the costs of your internet access.
16.2 The provider currently avails itself of the Austrian small business exemption. Insofar as the service is subject to VAT in Austria and the conditions for the small business exemption are met, no Austrian VAT will be charged or shown. For cross-border services, the tax treatment is governed by the applicable statutory provisions.
17. Right of withdrawal
17.1 In the case of distance selling transactions, consumers are entitled to the statutory right of withdrawal under the Distance and Off-Premises Sales Act (FAGG), provided that the relevant conditions are met. The statutory withdrawal period is generally 14 days.
17.2 Details regarding the right of withdrawal, the start of the withdrawal period, how to exercise this right and the consequences are set out in the separate withdrawal policy at https://mediations-akademie.online/training/widerrufsbelehrung/. The withdrawal policy will be made available in good time and, where required by law, will also be provided on a durable medium.
17.3 If you wish to use purchased credit before the withdrawal period has expired, we will, when the credit is topped up, obtain your express request for the service to commence early, as well as your acknowledgement of the associated consequences, as required by law.
17.4 If you validly withdraw from the contract within the withdrawal period, any services already used will be charged on a pro rata basis in accordance with the statutory requirements. Any unused credit purchased for a fee will be refunded.
17.5 Where the contract has been fully performed, the right of withdrawal may lapse in accordance with the statutory requirements.
17.6 Where required by law, we shall provide an electronic withdrawal function and confirm receipt of the notice of withdrawal on a durable medium (by email).
17.7 Withdrawal from a credit top-up will result in the reversal of the top-up in question. Free user access may continue, insofar as this is legally and technically possible.
18. Warranty
18.1 The statutory warranty provisions apply, in particular the Consumer Warranty Act (VGG), insofar as it is applicable.
18.2 We are obliged to ensure the agreed functionality of the platform and to provide the updates required by law, including security updates.
18.3 A single AI output that is factually incorrect, incomplete or deviates from another expert assessment does not in itself necessarily constitute a defect. Typical probabilistic fluctuations and limitations of AI are described in clause 8.
18.4 This does not affect cases in which an agreed function of the platform is not provided or is not provided in accordance with the contract, or where the AI-supported assessment or feedback function systematically fails to fulfil its agreed training function.
18.5 In the event of a defect, consumers are entitled to the statutory remedies.
19. Liability towards consumers
19.1 The platform is intended solely for training and practice purposes. AI-generated tasks, assessments, scores, feedback and chat responses may be incorrect, incomplete or vary in technical accuracy, and are no substitute for professional advice.
19.2 We shall only be liable for decisions or actions taken by users on the basis of such AI outputs in accordance with mandatory statutory provisions.
19.3 Mandatory statutory liability claims remain unaffected.
20. Complaints and dispute resolution
20.1 Complaints may be submitted informally to mail@mediations-akademie.online.
20.2 Consumers may contact the Internet Ombudsman’s Office for the out-of-court settlement of disputes arising from online transactions. We are not generally obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not generally take part in such proceedings. Voluntary participation in individual cases remains possible.
PART C — Additional Provisions for Business Customers
This Part applies if the transaction forms part of your business operations. Part B does not apply to business customers, unless mandatory statutory provisions stipulate otherwise.
21. No statutory right of withdrawal
21.1 The right of withdrawal under the FAGG is a consumer right. Traders are generally not entitled to a statutory right of withdrawal or cancellation under the FAGG.
22. Prices, VAT and Invoices
22.1 The Provider currently avails itself of the Austrian small business exemption. Where a service is subject to VAT in Austria and the conditions for this exemption are met, no Austrian VAT will be charged or shown on the invoice.
22.2 For services provided to customers outside Austria, the VAT treatment is governed by the applicable statutory provisions. In particular, the reverse-charge mechanism or other cross-border regulations may apply to services provided to businesses.
22.3 Business customers are obliged to provide the information required for correct tax treatment – in particular, any VAT registration number, as well as details of their registered office and company – in full and accurately, and to notify the provider of any changes without delay.
22.4 Invoices are provided electronically.
23. Warranty in relation to business customers
23.1 The warranty period for business customers is twelve months, insofar as such a reduction is permitted by law. In all other respects, the statutory provisions apply.
23.2 Clauses 18.3 and 18.4 apply mutatis mutandis to the distinction between typical AI fluctuations and a functional defect.
24. Liability towards businesses
24.1 The platform is intended solely for training and practice purposes. AI-generated tasks, assessments, scores, feedback and chat responses may be incorrect, incomplete or vary in technical detail, and are no substitute for professional advice.
24.2 To the extent permitted by law, we accept no liability for decisions or actions taken by users on the basis of such AI outputs.
24.3 Mandatory statutory liability claims remain unaffected.
25. Use in education and further training
25.1 The platform may be used, made available or recommended for training and professional development purposes, including within the context of education and further training.
25.2 It is not permitted to use the platform’s scores or AI assessments as a binding basis for examination decisions, certifications, accreditations or the formal assessment of learning outcomes.
25.3 Any use of the platform under a third-party brand, as a white-label offering or as a standalone product requires our express consent.
PART D — Final Provisions
26. Data Protection
Information on the processing of personal data, the service providers and AI providers used, and any transfers to third countries can be found in our current privacy policy at https://mediations-akademie.online/training/datenschutz/. The prohibition on entering the personal data of real individuals into the AI functions is set out in clause 11.1.
27. Accessibility
Any comments regarding barriers to access or the accessibility of the platform may be sent tomail@mediations-akademie.online .
28. Final provisions
28.1 Should any provision of these General Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the relevant statutory provision.
28.2 Declarations made within the framework of the contractual relationship may, to the extent permitted by law, be made in writing, in particular by email.
28.3 Rights and obligations arising from the user agreement may only be transferred with the consent of the other party, unless mandatory law provides otherwise.
28.4 The contractual relationship shall be governed by Austrian law, to the exclusion of the conflict-of-laws rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG). With regard to consumers, mandatory protective provisions of the country of their habitual residence shall remain unaffected, insofar as they take precedence under the applicable international rules.
28.5 If the user is a business, it is agreed that the court with subject-matter jurisdiction in Salzburg, Austria, shall have jurisdiction over all disputes arising out of or in connection with the user agreement, including disputes concerning its formation, validity and termination. The provider is also entitled to bring claims against businesses at their general place of jurisdiction. For consumers, the mandatory statutory provisions on jurisdiction shall apply. Mandatory statutory provisions on jurisdiction, in particular exclusive jurisdictions under EU law, remain unaffected.
28.6 Date: 17 September 2026 · Version 1.0.
